Harrington man arrested after fleeing from window

HARRINGTON – A wanted Harrington man was arrested Sunday after he attempted to flee out of a window.

Merlin L. Smith, 46 of the 800 block of Mason Ave., had warrants out for his arrest by both the Harrington Police Department and the Delaware State Police along with three capias, according to the Harrington Police Department who arrested him June 26.

The Harrington and Felton Police Departments were dispatched to Smith’s residence after someone called, reporting that he was wanted. Police conducted a computer check, confirming the warrants and capias.

When police arrived at the residence and knocked on the door, an officer observed Smith attempting to escape out a first floor window.  The officer attempted to take Smith into custody, but he began resisting arrest.

After a short struggle, he was successfully taken into custody and transported to the Harrington Police Department for processing.  The Harrington Police Department charged him with criminal contempt of a domestic violence protective order. The Delaware State Police charged him with failure to register as a sex offender within three days of changing address.

Smith’s capias included failure to appears out of Kent County Family Court and Kent County Court of Common Pleas. He was arraigned via video phone at Justice of the Peace Court 7 on all warrants and capias.  He was then committed to the Sussex Correctional Institute in default of $2,350 cash bond and $500 Secured bond.  Mr. Smith was also issued a Criminal Summons for Resisting Arrest.
