Three Harrington residents arrested after fight at Rudy’s

HARRINGTON – Three Harrington residents were arrested after a fight broke out in Harrington June 22.

Police responded to Rudy’s Diner at 2:29 a.m. for a report of a fight in progress inside the diner.

Just before police arrived, the suspect’s left in a vehicle, however, officers were able to get the vehicle stopped prior to it leaving the parking lot.

During the course of the investigation, police determined that Matthew A. Layton, 27 of Brownsville Rd. in Harrington, and Philip A. Rust, 24 of Drapers Corner Road in Harrington, were inside the diner when the pair began making derogatory comments towards another patron.

Gavin K. Smith, 21 of Andrewsville Road in Harrington, who was with the patron then confronted Layton and Rust and an argument ensued, escalating into a fight.

During the fight, some property was damaged. All were taken into custody and processed at the Harrington Police Department.

Layton and Rust both charged with conspiracy in the third degree, offensive touching, criminal mischief under $1,000 and disorderly conduct.

Smith was charged with offensive touching, criminal mischief under $1,000 and disorderly conduct. All were arraigned via video phone at Justice of the Peace Court 7. All were released on unsecured bond.
